Waste Collection Islington Service Terms and Conditions
These Terms and Conditions set out the basis on which Waste Collection Islington provides waste collection and related services to domestic and commercial customers within its service area. By placing a booking, you agree to be bound by these Terms and Conditions. Please read them carefully before confirming any service.
1. Definitions
In these Terms and Conditions, the following expressions shall have the meanings set out below:
Customer means the individual, business, organisation or other entity requesting and paying for the services.
Company means Waste Collection Islington, the provider of waste collection and related services.
Services means any waste collection, removal, clearance, loading, transportation, or associated services provided by the Company.
Waste means any materials, items, goods, rubbish or refuse collected or intended to be collected by the Company as part of the Services, including household waste, commercial waste, bulky items and recyclable materials, but excluding any prohibited or hazardous items as defined in applicable regulations or in these Terms and Conditions.
Service Area means the geographical area within which the Company agrees to provide Services from time to time, primarily focused on Islington and surrounding locations, as determined by the Company at its sole discretion.
2. Scope of Services
The Company provides waste collection and related services within the Service Area, which may include:
One-off or scheduled household waste removal.
Commercial and office waste collection.
Bulky item and furniture removal.
Garden and green waste collection.
Light clearance of premises in connection with waste removal.
The exact scope of the Services for each booking will be set out in the confirmation provided to the Customer. The Company is under no obligation to collect items not referenced or reasonably inferred from the Customer's description at the time of booking.
3. Booking Process
3.1 A booking may be made by telephone, email, online form, or any other method accepted by the Company from time to time.
3.2 The Customer must provide accurate and complete information when requesting Services, including but not limited to:
The full address of the collection location.
Contact details for access and communication.
A clear description of the type, approximate volume and nature of the Waste to be collected.
Any access restrictions, parking limitations or time constraints.
3.3 The Company will provide an estimate or quote based on the information supplied. This may be given as a fixed price or as a price range depending on the nature and volume of the Waste described.
3.4 The booking will be deemed confirmed only when the Company has accepted the booking request and, where required, received any initial payment or deposit. The Company reserves the right to refuse any booking at its sole discretion.
3.5 If, upon arrival, the actual volume, type or nature of the Waste differs substantially from that described at the time of booking, the Company may adjust the price, decline to carry out part or all of the Services, or propose an alternative arrangement. Any additional charges will be explained to the Customer before proceeding.
4. Access and Service Requirements
4.1 The Customer is responsible for ensuring safe, reasonable and timely access to the collection location at the agreed time.
4.2 The Customer must ensure that:
Any required parking permissions or permits for the Company's vehicles are in place.
Any gates, doors or access routes are unlocked and unobstructed.
Waste is presented in a manner consistent with the description provided at booking.
4.3 If the Company is unable to carry out the Services due to inadequate access, unsafe conditions, or because the Customer is not present where required, the Company may charge a call-out fee or treat the booking as cancelled by the Customer.
4.4 The Company may refuse to carry out Services if, in its reasonable opinion, doing so would pose a risk to health and safety, contravene legislation, or fall outside the agreed scope.
5. Payments and Charges
5.1 All prices are quoted in pounds sterling and are exclusive of any applicable taxes unless otherwise stated.
5.2 Payment terms will be communicated at the time of booking. Unless agreed otherwise in writing, payment is due either in advance or immediately upon completion of the Services.
5.3 Payment may be made by any method accepted by the Company from time to time, which may include cash, debit or credit card, or bank transfer.
5.4 The Company reserves the right to charge interest on overdue amounts at the statutory rate applicable under UK law, accruing on a daily basis from the due date until the date of actual payment in full.
5.5 If the Customer disputes any charge, the Customer must notify the Company in writing as soon as reasonably practicable, setting out the basis of the dispute. The undisputed portion of any invoice must still be paid by the due date.
5.6 The Company may amend its standard rates and charges at any time. Changes will not affect confirmed bookings that have already been paid in full, unless the scope of the Services is subsequently varied by mutual agreement.
6. Cancellations and Amendments
6.1 The Customer may cancel or amend a booking by contacting the Company directly, subject to the following provisions.
6.2 If the Customer cancels more than 24 hours before the scheduled collection time, any pre-paid amount may be refunded or applied to a rebooked service, at the Company's discretion, less any reasonable administrative costs.
6.3 If the Customer cancels within 24 hours of the scheduled collection time, the Company may charge a cancellation fee up to a reasonable proportion of the quoted price to cover costs already incurred, including staffing and vehicle allocation.
6.4 If the Customer fails to provide access at the agreed time, or the Company is prevented from carrying out the Services due to circumstances within the Customer's control, the Company may treat this as a late cancellation and apply the appropriate fee.
6.5 The Company will use reasonable efforts to accommodate requests to change the collection time, date or scope of Services. However, the Company is under no obligation to accept any changes and may treat substantial changes as a new booking.
6.6 The Company reserves the right to cancel or reschedule a booking due to events beyond its reasonable control, including but not limited to vehicle breakdown, adverse weather, staff illness or safety concerns. In such cases, the Company will notify the Customer as soon as reasonably practicable and will offer a rescheduled appointment or a refund of any payments made for Services not delivered.
7. Waste Types and Regulations
7.1 The Company operates in accordance with UK waste management legislation and local authority requirements. All Waste collected will be transported and disposed of, or recycled, using authorised facilities and methods.
7.2 The Customer is responsible for ensuring that Waste presented for collection is accurately described and does not contain prohibited, hazardous or regulated materials unless expressly agreed in writing and in compliance with all applicable laws.
7.3 Without limitation, the Company will not ordinarily collect the following types of waste:
Asbestos or materials containing asbestos.
Chemicals, solvents, oils, fuels or paints.
Clinical or medical waste, including sharps and pharmaceutical products.
Gas cylinders and pressurised containers.
Explosives, flammable liquids or other dangerous goods.
Any item classified as hazardous or special waste without prior agreement.
7.4 If restricted items are discovered during collection, the Company may refuse to remove them, adjust the quoted price, or terminate the Services immediately. The Customer may be liable for any additional costs incurred as a result of misdescription or concealment of prohibited items.
7.5 The Customer remains responsible for any Waste that is not removed as part of the agreed Services.
8. Customer Obligations
8.1 The Customer warrants that they have the right, title and authority to request the removal of the Waste and that the Waste does not belong to any third party without consent.
8.2 The Customer must not request or permit the Company to remove items that are subject to finance agreements, retention of title clauses, or other encumbrances without appropriate authorisation.
8.3 The Customer is responsible for ensuring that no valuables, personal documents or items intended to be retained are included in the Waste. The Company accepts no responsibility for any such items removed in error once the Waste has been collected.
9. Liability and Limitations
9.1 Nothing in these Terms and Conditions excludes or limits the Company's liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other matter where liability cannot lawfully be limited or excluded under UK law.
9.2 Subject to clause 9.1, the Company's total aggregate liability to the Customer arising out of or in connection with any Services, whether in contract, tort, negligence or otherwise, shall not exceed the total amount paid or payable by the Customer to the Company for the specific Services giving rise to the claim.
9.3 The Company shall not be liable for:
Loss of profit, revenue or business.
Loss of data, goodwill or reputation.
Any indirect, consequential or special loss or damage.
9.4 The Company will take reasonable care when carrying out the Services, including when handling Waste within the Customer's property. The Customer must notify the Company in writing of any alleged damage to property or possessions within 48 hours of completion of the Services, supplying reasonable evidence. Failure to do so may prejudice any claim.
9.5 The Company will not be liable for damage arising from inherent defects, weaknesses or pre-existing conditions in the Customer's property, access routes, driveways, surfaces or structures, or where the Customer has insisted on a method of working against the Company's advice.
9.6 The Customer shall indemnify the Company against any claims, losses, damages, costs and expenses arising from:
A breach by the Customer of these Terms and Conditions.
The inclusion of prohibited, hazardous or misdescribed Waste.
Any third-party claim alleging that the Company was not authorised to remove the Waste.
10. Delays and Force Majeure
10.1 The Company will use reasonable efforts to carry out the Services at the agreed time but cannot guarantee exact arrival or completion times. Time is not of the essence in relation to performance of the Services.
10.2 The Company shall not be liable for any delay or failure to perform the Services to the extent caused by events beyond its reasonable control, including but not limited to extreme weather, traffic disruptions, accidents, industrial disputes, power failures, or actions of public authorities.
11. Insurance
11.1 The Company will maintain such public liability and other insurance cover as it reasonably deems appropriate for the nature of its Services and as required by applicable law.
11.2 Details of insurance cover may be made available to the Customer upon reasonable request.
12. Data Protection and Privacy
12.1 The Company will collect and use personal information provided by the Customer to process bookings, deliver Services, handle payments, and manage customer relationships in accordance with applicable data protection laws in the United Kingdom.
12.2 The Customer is responsible for ensuring that any personal data they supply is accurate and for updating the Company of any changes to contact details relevant to the provision of Services.
13. Complaints and Dispute Resolution
13.1 If the Customer has any concerns or complaints about the Services, they should contact the Company as soon as possible, providing full details of the issue.
13.2 The Company will investigate complaints in good faith and seek to resolve them promptly, which may include offering a remedy, partial refund or reattendance where appropriate and at the Company's discretion.
13.3 If a dispute cannot be resolved amicably, either party may pursue any remedies available to it under English law.
14. Variations to Terms
14.1 The Company may amend these Terms and Conditions from time to time. Any changes will take effect when posted or otherwise communicated and will apply to new bookings made after that date.
14.2 The version of the Terms and Conditions in force at the time of booking will apply to that booking, unless a variation is specifically agreed in writing between the parties.
15. Severability
15.1 If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be severed to the extent necessary, and the remaining provisions shall continue in full force and effect.
16. Entire Agreement
16.1 These Terms and Conditions, together with any written quotation or booking confirmation issued by the Company, constitute the entire agreement between the Company and the Customer in relation to the Services.
16.2 The Customer acknowledges that they have not relied on any statement, promise or representation not expressly set out in these Terms and Conditions or in the relevant booking confirmation.
17. Governing Law and Jurisdiction
17.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.
17.2 The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Services, or their formation.
By placing a booking with Waste Collection Islington, the Customer confirms that they have read, understood and agree to be bound by these Terms and Conditions.
